Post-1537...

I received this notice from Blogger:

Blogger has been notified, according to the terms of the Digital Millennium Copyright Act (DMCA), that certain content in your blog is alleged to infringe upon the copyrights of others. As a result, we have reset the post(s) to "draft" status. (If we did not do so, we would be subject to a claim of copyright infringement, regardless of its merits. The URL(s) of the allegedly infringing post(s) may be found at the end of this message.) This means your post - and any images, links or other content - is not gone. You may edit the post to remove the offending content and republish, at which point the post in question will be visible to your readers again.

A bit of background: the DMCA is a United States copyright law that provides guidelines for online service provider liability in case of copyright infringement. If you believe you have the rights to post the content at issue here, you can file a counter-claim. For more information on our DMCA policy, including how to file a counter-claim, please see http://www.google.com/dmca.html.

The notice that we received, with any personally identifying information removed, will be posted online by a service called Chilling Effects at http://www.chillingeffects.org. We do this in accordance with the Digital Millennium Copyright Act (DMCA). You can search for the DMCA notice associated with the removal of your content by going to the Chilling Effects search page at http://www.chillingeffects.org/search.cgi, and entering in the URL of the blog post that was removed. If it is brought to our attention that you have republished the post without removing the content/link in question, then we will delete your post and count it as a violation on your account. Repeated violations to our Terms of Service may result in further remedial action taken against your Blogger account including deleting your blog and/or terminating your account. If you have legal questions about this notification, you should retain your own legal counsel.

Sincerely,

The Blogger Team

I wasn't informed which pix were the offending ones but that particular post has indeed been deleted from viewing. The men posted were: Michael Fitt / James Guardino / Mark Lamorie and I'm beginning to suspect that noting their names was what caught the eye of someone who didn't like being mentioned. This could be a warning to all bloggers.

  1. Of all the nerve.............!!!!!
I dont think Blogger had any need to send you something like that. If they just wanted you to remove the names [what they said was a bit complicated but I gather that was the gist] then they shoulve just said that. Talk about over-reaction! Can only think one of the guys concerned objected to his pic being put up...shouldnt have posed for it then! I think that message they sent was a bit over-the-top. And heres me thinking the internet was a free-for -all.

  2. hi rick

hope this isn't going to be the beginning of blogger harassment - i've had two more (five in total now) removed - problem i think was that the names of the blogs were too similar and related to two addys - so as you know nickoliviera@gmail.com

do you know what posts are the ones they are referring to?

i must say as you've probably noticed that i don't mention names - after all the fuss i've had

i do ID guys - by putting the first comment in with names - my guess is that this gets around this issue

    hang tough my friend

    cheers

  3. Karl - Yeah, it would have been nice of the person who contacted Blogger to just have contacted me and I'd have taken them down.

Nick - The offending post is mentioned in the letter but not which pix they referred to. I'm gonna take your advice and not use their names anymore.

  4. Something tells me its the Michael Fitt pics - He's a bit more famous than the others.
Interesting though that they actually went through all the bother and contacting you about it like that.
I have had only one time in all my LONG years of blogging that I have had a copyright problem. Supposedly it was one of my very favorite porn star's lawyer that had contacted me.
That's all I'll say on that score! lol

  6. Hi SR:

I love your blog and thank you for your time. If this blogger harrassment keeps up, then who the hell would want to take the time to do a blog if bloggers are going to get bullied?

Message to BLOGGER: Tres De Classe'!

SR, don't let the bastards get to you, you are a class act my friend!
