Good for Judge Reeves...(and in Mississippi, too). I'm not a lawyer but this strict constructionism nonsense is, to me, to law what trickle-down is to economics and scientific creationism is to science.

ReplyDeleteMore proof that Clarence Thomas is one of 6 SCOTUS justices that would like to see this country rolled back to the 1880s.
ReplyDeleteThomas' decree raises several questions in my mind and I'm not sure where or why to look for answers. What gives one SCOUS member the power or authority to demand that all justices follow his decree? Why look to the past when we live in the present and need to think about the future? Does Thomas realize the changes in technology since that amendment was added? Do we ignore those changes? Shouldn't his proposal or decree be up for scrutiny by scholars as any other hypothesis? Is the Supreme Court still, as Justice Roberts claims, a trustworthy institution? How can we trust Thomas who's already compromised.

Can't forget about the issue of "well-armed militias", either! As if that gives individuals the capabilities to form groups (as Proud Boys, Oath Keepers, and such) and be "constitutionally approved" to do what they seem to like to do. If Justice Thomas succeeds in getting us back to the 18th Century, then HE would be "as he would be as a Black person" and his marriage to a white woman would be very inappropriate. Curious that when he was mentioning all of the SCOTUS legal precendents which became law, "decided incorrectly" according to him, that inter-racial marriage was something that HE did not mention. I like that article, thanks for linking it!
